De facto partners may have similar rights to married couples in relation to property division, superannuation and spousal maintenance.

Property division following a separation in Australian family law is not based on a fixed formula. The Court considers factors such as each party’s financial and non-financial contributions, future needs, earning capacity and care of children. Assets can include real estate, savings, businesses, investments and superannuation. Early legal advice is essential to ensure property entitlements are properly assessed and protected.

Parenting decisions are made based on the best interests of the child. The Court considers factors including the child’s safety, emotional well-being, relationship with each parent and capacity of each parent to meet the child’s needs. Parenting arrangements can be resolved by agreement or, where disputes arise, through family law litigation. The focus remains on achieving stable and appropriate outcomes for children.

Yes, there are!  Strict time limits apply in family law matters. For married couples, property and spousal maintenance applications must generally be commenced within 12 months of divorce. For de facto relationships, applications must usually be made within two years of separation. Failing to act within these timeframes can significantly affect legal rights, making early advice critical.
